Estate Settlement

Probate is the process of putting the terms of your will into effect, including the gathering of all of your assets and the payment of any outstanding debts and taxes, the payment of the expenses associated with the administration of your estate, and the distribution of bequests to your heirs. The executor you named in your will has the responsibility to manage this process. The executor is entitled to a reasonable fee for performing these services. Due to the complexity of the law and the legal problems that are involved in estate administration, the Court requires that all executors have legal counsel. Good legal advice and guidance can expedite the probate process, prevent costly errors, and protect the fiduciary.

Trust Settlement

Settlement of an estate through a Trust is very similar to the settlement of an estate through probate. The same basic steps are necessary, but many documents do not need to be filed with the court as in a probate. Because significant decisions need to be made during the trust administration process, it is important for you to have the advice of an attorney, accountant, and financial advisor to guide you through the process.
